Booking Terms and Conditions - Cote d'Azur

Upon written confirmation from JDV Holidays (JDV) that your holiday reservation is accepted, a formal contract is formed between you (the holidaymaker) and the Property Supplier (the Property Owner) who agrees to provide your holiday accommodation.  JDV are not party to this contract and act only as an intermediary between you and the Property Owner.

The following terms and conditions form the basis of your contract with the Property Owner.

Your Booking and Payment

To reserve a Property, you must complete and submit the JDV Booking Form and return it together with payment of the initial non-refundable deposit (25% of the total Price due). The booking form must be signed or electronically submitted by an adult party leader who, in doing so, accepts all of the Terms and Conditions on behalf of all the party members.

Whilst we like you to have made some enquiries regarding your flights/travel plans before making a booking, we would strongly advise that you do not actually book these until we have your dates firmly on hold with the owner, and you have received the formal acceptance of your booking. 

Following receipt of the Booking Form and deposit, JDV will send an email to confirm the booking. This is the formal acceptance of the booking and creates a binding contract between you and the Property Owner.  Please check your holiday details carefully at this point and contact us immediately if the information is incorrect or incomplete.

The balance of the holiday Price is payable not less than ten weeks before the start of the rental period. If payment is not received by the due date, JDV reserves the right to give notice in writing/by email that the reservation is cancelled, and charge a cancellation fee.  
Reservations made within ten weeks of the start of the rental period require full payment at the time of booking.

Cancellations and Amendments

All amendment requests and cancellations must be notified to JDV in writing/email and the date this correspondence is received by JDV will be used to, where applicable, calculate any refund the holidaymaker is due.

Where a booking is cancelled the following cancellation charges are payable by the Holidaymaker to JDV.

 Even where your Balance Payment has not been received, the above timescales and charges for cancellation apply.

Depending on the reason for cancellation you may be able to reclaim these charges under the terms of your insurance policy.

In the unlikely event that JDV have to cancel or amend your chosen accommodation, we will strive to offer you an acceptable and comparable alternative. If this is not possible we will refund in full all monies you have paid us for your accommodation, but will not be under any further liability.  If the acceptable alternative is more expensive than the original price you have paid, you must pay the additional costs.  If it less expensive we shall refund the difference.


All holidaymakers MUST have a comprehensive travel insurance policy (including cancellation cover) and full cover for the party's personal belongings, public liability, personal injury and illness, damage to the property and/or its contents caused by you or your party etc.


Once you have received a booking confirmation statement/email from JDV, the price of your holiday accommodation is fixed. JDV reserve the right to change the advertised price of a property at any point until written confirmation of a booking is issued by us.

Details of your Accommodation

Once JDV has received the full payment for your accommodation, we will send you an individual Property Information Document(PID) This contains the specific details of your holiday accommodation, including items such as end of stay cleaning, linen and towel provision, electricity/gas/heating costs, tax de sejour, baby facilities, parking, internet and telephone facilities. 

By completing the JDV booking form and accepting our Terms and Conditions you also accept the specific terms of the PID.

The information given in the PID and provided on our website has been compiled with all reasonable care to ensure that the description of the Property is correct and none of the facts given are knowingly false or misleading.  We undertake to advise you of any subsequent changes which become known to us and which may amount to a material alteration in the property or in the details supplied to you, however, we cannot be held liable for changes which occur without our knowledge and therefore outside our reasonable control.

The PID states when the rental period shall commence and finish. JDV and the Property Owner shall not be obliged to offer accommodation before the time stated and the Holidaymaker shall not be entitled to remain in occupation after the time stated.

The maximum number to reside in the Property must not exceed that stated on the JDV Holidays website or in the PID unless JDV has given written permission. 

The property Owner may collect a security/damage deposit from you, as stated in the Property Information Document. This shall be held by the Owner on trust for the Holidaymaker except in the event that any damage is caused to the Property (including but not limited to furnishings, fixtures fittings and décor) caused by the Holidaymaker(s) during their occupation of the Property. In this case the Owner shall retain that part of the deposit to cover payment for such damage. 

The property will be cleaned prior to your arrival. You agree to be a considerate tenant and to take good care of the Property and to leave it in a clean and tidy condition at the end of the rental period. The Owner reserves the right to make retention from the security/damage deposit to cover additional cleaning costs if you leave the Property in an unacceptable condition. You also agree not to act in any way, which would cause disturbances to those residents in neighbouring properties.

Both JDV and the Owner reserve the right to remove you from the property without notice and without compensation in the event of serious misuse, abuse or damage of the property and its contents.

The holidaymaker and party acquire no rights whatsoever over the Property except occupation as a holiday let for the period booked. You shall not sublet the Property. 

You must report to the Owner (or Owner's Agent) without delay any defects in the Property or breakdown in the equipment, such as plant, machinery or appliances in the Property, garden or swimming pool. Arrangements for repair and/or replacement will be made by the Owner as soon as possible.


In the unlikely event you are dissatisfied with any aspect of your holiday accommodation, you should immediately report this to the Property Owner. If matters can not be resolved quickly on site you should then notify us by telephone as soon as possible. Any problem which threatens to seriously affect your enjoyment of the holiday must be reported to us and the Property Owner within 24 hours of such matter arising and confirmed to us in writing as soon as possible. Should we receive written notification of a complaint, we will endeavor to deal with this in a professional and speedy manner.

The obligation on your part to contact us whilst you are at the property gives us the opportunity of carrying out remedial action. We accept no liability for any claims not dealt with in accordance with these terms and in particular where we are not given an opportunity to rectify the matter.

JDV shall not be liable to the Holidaymaker:

For any temporary defect or stoppage in the supply of public services to the Property, nor in respect of any equipment, plant, machinery or appliance in the Property, garden or swimming pool.

For any loss, damage or injury which is the result of adverse weather conditions, riot, war, strikes or other matters beyond the control of JDV.

For any loss, damage or inconvenience caused to or suffered by the Holidaymaker if the Property shall be destroyed or substantially damaged before the start of the rental period. In such event JDV shall, within seven days of the notification from the Holidaymaker, refund to the Holidaymaker all sums previously paid in respect of the rental period.

For any loss, damage or inconvenience caused to or suffered by the Holidaymaker if local events in close proximity to your accommodation create increased noise, disruption, or disturbance.

Under no circumstances shall JDV’s liability to the Holidaymaker exceed the amount paid to JDV for the rental period.

The use of accommodation and amenities where offered such as swimming pool etc. is entirely at the user's risk and no responsibility can be accepted for injury to a user or visitor and loss or damage to the user's or visitor's belongings.

No responsibility can be accepted for any loss or damage to any motor vehicle or its contents.

The bringing of pets on to the Property is forbidden except with the written permission of JDV.

No camping is permitted on the Property grounds except with the written permission of JDV.

This Contract shall be governed by English law in every particular including formation and interpretation and shall be deemed to have been compiled in England. Any proceedings arising out of or in connection with this Contract may be brought in any court of competent jurisdiction in England.
